What Is Citywide Home Loans – Data Breach Class Action Settlement?

The case is CURTIS V. CITYWIDE HOME LOANS, LLCTHIRD JUDICIAL DISTRICT COURT FOR SALT LAKE COUNTY, STATE OF UTAH.

What Is This Class Action All About?

The settlement provides benefits to settle claims relating to a Data Incident that occurred on or about November 18, 2020, whereupon an unauthorized individual gained access to Defendant’s environment and deployed ransomware, resulting in the encryption of certain of Defendant’s systems that Plaintiff alleges involved a compromise of the personally identifiable information of Defendant’s current and former employees, including, but not limited to, exposure of names, addresses, phone numbers, dates of birth, Social Security numbers, passport numbers, driver’s license numbers, credit card information, bank account information, and/or medical or insurance information. 

  • The settlement benefits include:
    • Defendant will provide the option to enroll in two years of credit monitoring and Identity Theft Protection Services (including $1,000,000 in identity theft insurance) through Kroll Associates, Inc., at no cost.
    • Defendant will pay valid claims submitted for Economic Losses (up to $5,000.00) and Lost Time (up to $200) you experienced related to the Data Incident. If valid claims exceed $1,225,000.00 payments to Class Members will be reduced pro rata. 
  • You have the right to do nothing, submit a Claim Form, object to the settlement or any part of it, or opt-out of the settlement. If you do not opt-out of the settlement, and final approval is granted, you will release any claims you have relating to the Data Incident as set forth in the Settlement Agreement. 

Who Is Eligible?

This settlement benefits all class members who were employed by Citywide Home Loans, LLC and sent a Summary Notice of the Data Incident between February and April of 2021.

How To Be Part of This Settlement

Class members must submit your Claim Form on-line no later than Tuesday, August 8, 2023, or mail your completed paper Claim Form so that it is postmarked no later than Tuesday, August 8, 2023.

If you wish to exclude yourself, you must complete and mail your request for exclusion form so that it is postmarked no later than Monday, July 10, 2023.

If you wish to object to the settlement, you must mail your objection(s) and/or notice of intent to appear at the Final Approval Hearing so that it/they are postmarked no later than Monday, July 10, 2023.

What Is The Pay For This Settlement?

The pay for this settlement varies and the proof of purchase is not necessary.

If you do nothing you will give up the right to bring a separate lawsuit about the same issues, and you will not be eligible to receive any benefits of the settlement.
